By creating an account, hosting an event, or sending a gift through EventArk (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. EventArk is operated from Canada.
You must be at least 13 years old to use EventArk. To receive money through the Service you must be at least 18 (or the age of majority in your jurisdiction) and have a valid Canadian payout method.
EventArk is a platform that lets event hosts collect cash gifts, wishlist gifts, experience gifts, and paid ticket RSVPs from guests. Payments are processed by Stripe; EventArk facilitates payouts to hosts. We are not a bank, broker, or financial institution and do not hold funds on your behalf longer than is necessary to process a payout.
You are responsible for the activity on your account, the accuracy of the information you provide, and for keeping your credentials secure. Notify us immediately if you believe your account has been compromised.

We may suspend or terminate accounts that violate these rules, with or without notice.
You retain ownership of content you upload (event titles, descriptions, photos, wishlists). You grant EventArk a worldwide, non-exclusive, royalty-free licence to host, display, and distribute that content as necessary to operate the Service.
Card payments are collected and processed by Stripe under their own terms. By receiving payments through EventArk you agree to Stripe's Connected Account Agreement and Services Agreement. Payouts are issued by EventArk to the payout method you provide. Processing times depend on Stripe's clearance window and our internal review.
Refunds are governed by our Refund Policy. In short: gifts are personal and generally final; ticket refunds are at the host's discretion. Chargebacks initiated through your card issuer follow Stripe's standard dispute process.

EventArk is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or secure against all attacks. Event content is created by users; EventArk does not endorse or verify the accuracy of event listings or claims made by hosts.
To the maximum extent permitted by law, EventArk is not liable for indirect, incidental, or consequential damages, lost profits, or lost data arising from your use of the Service. Our aggregate liability for any claim is limited to the greater of (a) the amount of fees paid to EventArk by you in the 12 months before the claim, or (b) CA$100.
You may stop using the Service at any time. We may terminate or suspend your account if you breach these Terms or for legal, security, or operational reasons. On termination, your right to use the Service ends; provisions that by their nature should survive (intellectual property, disclaimers, limitations of liability) will continue to apply.
We may update these Terms from time to time. Material changes will be announced by email or in-app notice. Continued use of the Service after a change means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Ontario.
